    If the HOA isn’t using the reserve funds properly, there could be serious consequences down the road. If you don’t have a reserve study in place, it’s critical to get one done so that everyone knows what’s really needed for long-term upkeep. It might also be worth checking if they’ve been funding it correctly.

    I agree with the above. Communication is key. We handled this by creating a designated pet area in the community and enforcing leash rules more strictly. Sometimes just making it easier for pet owners to follow the rules (like with designated spaces) can solve the problem. Regular reminders about fines help too.

    That seems like a “you” problem than a problem with your president. Unless you have proof of something suspicious going on, then you’re just being prejudiced.

    HOAs and condos are pretty well-known for strange rules. This no bikini thing is definitely one of them but I see no harm in enforcing such a rule. I would be worried if it were the other way around and your HOA REQUIRED bikinis.

    @cascascassie I’m not sure why we’re in a deficit (I’m not on the board but I am a VERY concerned homeowner). I’ll have to bring that up at the next board meeting.

    Unfortunately, looking for a management company that we can afford isn’t as easy as it sounds. We’ve been forced to cut a lot of our spending due to a budget deficit.

    For your first question, hoaprez3 is correct. You prolly do need to organize as a nonprofit corporation under state law.

    As for your second question. yes HOA’s do need to pay and file tax returns. Just cuz you are incorporated as a nonprofit doesn’t mean yo0u’re automatically excempt from taxes. To qualify as a tax-excempt nonprofit, you must meet the IRS requirements under 501(c)(4). On a federal level most file Form 1120-H or 1120. State tax forms can vary so best to check that out your self.
