    I recommend talking to a competent lawyer who understands HOAs, LLCs, and contract law.

    I agree that the board at the time messed up, but your current status may complicate efforts to undo it since the laws governing an LLC will differ from those governing HOAs. You may have additional issues that need to be unwound (e.g., have you been filing incorrect tax returns all this time). It would be easy to mess things up further if you’re not working with someone who knows what they’re doing.

    I’m pretty sure they’re violating some of the rules, too. Loud music at night is in clear violation of our noise rules, but the HOA doesn’t do anything about it. They block my driveway, usually in the morning which makes me late to work. It’s not a clear violation of the rules, but parking has to be regulated by the HOA, am I right? As for the not-so-nice encounters, I admit, that’s not covered by the HOA. But it sure doesn’t help me warm up to my neighbor.

    We leave our gate open not because of the potential wear and tear but to have more access in case of an emergency. I suppose it’s an HOA decision. If you don’t feel safe leaving the gate open during the day, you should talk to your contractor.

    Thank you for the heads up! I’ll definitely be careful with mediation, and I’ll keep pushing the HOA to take action. It’s just frustrating when they seem unresponsive.

    I appreciate the advice. I’ll give the direct approach another shot, and if that doesn’t work, I’ll look into mediation services. Has anyone here had success with mediation in neighbor disputes?

    Good point! I’ve started keeping a log of incidents, but I’ll definitely look into local regulations. In the meantime, any advice on dealing with the neighbor directly without escalating the situation?

    Well, my neighbor has been consistently rude—loud music late at night, blocking my driveway, and even some not-so-friendly encounters. I’ve tried talking to them, but it doesn’t seem to make a difference. I reached out to the HOA, but they haven’t been much help. Any thoughts on what I can do?

    I did just open a business but I don’t intend to use that membership list for this purpose. It just seems like the board is assuming the worst and basing their decision on assumptions.

    We went back to f2f meetings a long time ago! A lot of people still wear masks though… totally their choice.

    If you found one contractor that took advantage of your awful board then their may be others. I suggest examining your other contracts as well. You might also benefit from a third-party audit of your finances just to be on the safe side, but this will cost somewhere between 5-10 grand. Melanie
