It depends on your governing documents. Most HOAs have the right to inspect common areas, but private backyards? That’s unusual unless they have a specific reason.

Allowing a delinquent owner to run for Board president is a very slippery slope. If they win, that person can influence a lot of decisions that have to do with delinquencies and late fees. Think about it – wouldn’t someone who is behind on their assessments want to change the policy for collections? That person likely has an ulterior motive for wanting to gain enough power in your association. I would advise against letting them run.

Our HOA works a little differently. In our case, the CC&Rs clearly state that homeowners has to re-certify the association thru a written document. That means we all have the option to vote whether or not we would like to stay as an HOA every year. If we didn’t met the minimum vote, then the HOA can’t enforce any rules anymore and would cease to exist for that year. It’s all a bit complicated really.
