Good luck! Keep your eyes peeled for any mail from the county too. Sometimes if there’s an active or dormant HOA, they’ll send you notices through the mail you might’ve missed. Better to be safe than sorry. Let us know how it goes!

I think yall should be careful with this one… My friend thought there wasn’t an HOA in her area too, but turns out it was just “dormant” (like someone mentioned). They hadn’t been collecting fees for years, but they still had legal rights to enforce rules. Eventually, they started sending out fines for stuff like fence height and house color. You might not see anything now but the rules could still be on record somewhere. I say talk to a lawyer just in case before you assume anything.

I’d restart the social events if I were you — but update them. Do more social events that specifically target the young people in your community. Not sure what those events would be as I am not a young person myself but I imagine this will work for you. Perhaps charity fundraisers or a community-wide cleanup?

I’ve encountered far too many situations like yours where the seller either intentionally or unintentionally left out the fact that there is an HOA governing the house. You might be able to file a claim against your attorney or real estate agent for not doing their due diligence in finding out that there was an HOA. Outside of selling your home and moving out, I’m afraid there is nothing you can do to opt out of membership (if it is a mandatory HOA, which most usually are).

I understand liens and foreclosures are the common recourses but I kind of feel bad for the delinquent owners. Apart from payment plans (which they can’t pay anyway), are there any other solutions?

I suggest you talk to your association’s attorney about this problem, Ginnie. They should be able to help you decipher the laws in your local area as well as your covenants and restrictions.
