    Is there a law that prevents the BOD to provide feedback on violation submitted by a homeowner?

    I don’t think so. Depends on where you are, but I’m not aware of any laws (federal or state) that says the BOD can’t provide feedback on violations.

    What can be done for BOD members not enforcing the covenants or picking and choosing what they will enforce?

    Beyond taking legal action, you might want to remove those board members. That’s selective enforcement what they’re doing.

    That just happened to a homeowner in my community who sent concerns about violations to the property manager. The property manager then sent the email to the board and copied the homeowner on it. The results were not good. One BOD member asked why the homeowner cared since the violation didn’t cause any harm or inconvenience to the homeowner. Since then a BOD’s daughter has sworn at the homeowner making the violation complaint. The manager has yet to intervene.

    Homeowners have options when the Board fails to do their fiduciary duty or neglects the provisions of your CCR’s.
    1: Provide in writing to the Board, your concerns that they are not acting properly as the documents require
    2: Go to a Board meeting with other owners and during owner participation, let the Board know of your concerns and ask why the document provisions are not being adhered to.
    3: If ignored, in Florida, you must file for a non binding arbitration to discuss in front of court appointed arbitrator your concerns, before legal action is taken
    4: If the arbitration fails to produce a solution, you can file for binding arbitration, or an action in circuit court, against the Board/HOA
    5: Organize the community to do a recall on the Board members who are not doing their duties.
    6: vote them out at the next Annual meeting
