Pool Rules – HUD/FHA Compliance

    After learning of the fact that our pool rules are not compliant with HUD regarding familial discrimination we are working on revising our rules which restrict children under 18 entering the pool area without adult supervision. Per our attorney HUD restriction, for safety reasons, is allowable and recommends that the age be lowered to 13-14. In searching for info I also saw that several cases with HUD also indicated that you could not use the term “adult supervision”. But they did not provide acceptable wording regarding the supervision of children under 14 years of age. Any suggestions for wording regarding supervision?

    It was funny that the judge noted that not all adults could swim. Some members of the community want to eliminate all reference to age and require that people be proficient swimmers. I am against this as who determines who is a proficient swimmer and are we going to test every person, adults included? As well as what is a “proficient” Swimmer? This also increases liability for the HOA.
