Neighbor’s dog bit me. Is HOA responsible?

    So, my neighbor’s dog bit me when I was walking past their yard. I had to go to urgent care, and now I’m wondering if the HOA is responsible for this in any way? I mean, shouldn’t they be enforcing rules about dangerous animals?

    Ouch, sorry to hear that! But no, the HOA usually isn’t responsible for stuff like that. It’s the owner’s responsibility to keep their dog under control. You should probably talk to your neighbor directly and maybe file a report if it’s serious.

    Yeah, @peggysus is right. The HOA might have rules about pets, but they’re not liable for something like a dog bite. You should definitely let the HOA know, though. If this dog is dangerous, they can warn the owner or even fine them.

    Also, check if your HOA has any rules about reporting aggressive pets. Some HOAs require owners to register their dogs, and if it happens again, they might be forced to remove the dog from the property. But legally, the bite falls on the neighbor, not the HOA.

    Thanks, everyone! I’ll definitely report it to both the HOA and the local authorities. Not cool having an aggressive dog around.

    Initially, the HOA is not responsible, however, your documents should include some type of regulation about dog nuisance…barking, being aggressive, etc. First what you should do is make a report with your local animal control dept, if the bite is serious enough, go to a medical facility, take photos. Second, notify your HOA that you were bitten by the dog and furnish the reports to them and ask them to act on this matter to what your documents allow. If they refuse, or ignore, and the dog bites someone again, they are responsible for being negligent in acting against the first incident.
    Our HOA has a clause that the Board may remove the dog(s), for violating any part of the documents, which they did on one occasion when an owner had two dogs loose and they attacked a resident causing some bites to her arms and torso. Once the animal control did there investigation, the Board sent notice to the owner to remove the dogs permanently from the community. People asked if it was legal to do, and yes, since its within the documents, it is legal.
