I HAVE HAD ENOUGH OF MY HOA. THEY KEEP SENDING ME NOTICES OF VIOLATIONS THAT ARE CLEARLY NOT DESERVED. I AM LIVID!!!!

What do the notices say? What violation is your HOA claiming?

It’s important to read the notices carefully. They should tell you what rule you’ve broken. Then, check your covenants to confirm if you’ve actually violated them. If you have, fix it. If you haven’t, talk to your HOA board. Depending on where you live, you should be able to attend a hearing to plead your case.

A lot of homeowners don’t know the rules of their HOA, which is why they end up breaking them. Then, they throw a fit over violation notices that they believe are unwarranted. Take the time to educate yourself first before you jump to conclusions. It’s not uncommon for homeowners to end up in the wrong. However, there are also cases wherein the HOA made a mistake. Investigate before you react.

You have the right to contact members of the Board to address any violations sent to you. Many owners do not understand that they have not only the right to do this, but the obligation to make sure the Board is enforcing violations correctly. The worse thing an owner can do, is ignore the notices. After a number of notices because the issue isn’t resolved, can incur fines. You do not want that to happen. As mentioned above, obtain a complete set of your documents and study the violations listed. You may be surprised at what the Board may consider as a violation, and again, contact the Board and have them explain why a violation was sent and if warranted, what is the solution to close the violation.
