HOA MISCONDUCT ON HOUSEHOLD MEMBER CONSIDERED TO BE DISABLED

    A member of my neighborhood HOA thought it would be funny to not only take a photo of my family member whom is disabled but issue a notice that says “ Dead tree removal from property”. As my curiosity grew to know as to what tree they were inquiring about being that we just had a tree installed a couple weeks ago; flipped the paper around and it was a full photo of my mom. Through a window of the members vehicle. No dead tree. This is not only inappropriate but during this incident. This HOA member decided to notify local law enforcement and allege that she was threatened with a discharged firearm. After reviewing every single camera outside of our household to get a clear story of what really happened . This was in fact, a false report made from this HOA member. When the police arrived, it alarmed the whole house and it created a domino effect of having to defend our rights from such abuse of power. This will be addressed at every level possible. This will also be address through the county justice court. So we can laugh it all out at that hearing.

    I’m sorry that happened to you. It sounds awful.

    Word of advice – make sure to document everything. Keep copies of the notice your neighbor sent you, along with the photo. You mentioned security camera footage; best to secure copies of those, too. Hire a lawyer with experience in this field of the law.

    It’s also good to notify your HOA board or manager about this incident.

    The Board member also committed a crime, filing a false felony police report is a crime. If they accused you of pointing a firearm at them, that would have been a felony, so make a complaint with the PD and prosecute the Board member. The possibility of a lawsuit for harassment is also possible.
