HOA denied my request for membership list

    I am under the impression that my HOA must comply with my request for the membership list (with contact information). I put in a request in writing 15 days in advance. Today, my board denied my request. Is this legal?

    There may be a reason behind the denial. Did the board indicate any reason?

    Hi @melcenaryx,

    According to Section 38-33.3-317 of the Colorado Common Interest Ownership Act, membership lists may not be used for commercial purposes, the solicitation of money, or any other purpose unrelated to the unit owner’s interest as a unit owner. The board must give its express permission otherwise. This could be why your board denied your request.

    I did just open a business but I don’t intend to use that membership list for this purpose. It just seems like the board is assuming the worst and basing their decision on assumptions.

    Perhaps you can approach the board and ask them to reconsider. Write an appeal and let them know that you will not be using the list for commercial purposes.
