HOA Denied My Fence But Approved My Neighbor’s?

    I recently applied to install a fence with a specific design in my backyard, but my HOA denied it. A few weeks later, my neighbor installed a very similar fence, and the HOA approved it. When I brought it up, they said the neighbor’s fence was actually not approved and is in violation. This feels like favoritism. Has anyone dealt with inconsistent HOA approvals?

    That sounds super shady. HOAs are supposed to follow their rules consistently. Have you asked to see the approval paperwork for your neighbor’s fence?

    I’d recommend sending a formal written request for clarification. Inconsistency in enforcement could be considered arbitrary, and you might have grounds to push back.

    I did email them, but they just reiterated that my neighbor’s fence wasn’t approved. No explanation why they didn’t catch it earlier. Should I get legal help?

    It might not be worth the cost of legal action unless this is a recurring issue. You could escalate by attending a board meeting and presenting your case in person.

    If the HOA enforces the rules inconsistently, you might have a strong case if this goes to arbitration or mediation. Document everything.

    What is the Board going to do about the unapproved fence? If they do nothing, erect the fence you want. On another note, if you are in Florida, you are allowed to store things in your back yard but it must be hidden from view from streets and adding properties. tell your board you are planning to bring ???? into your backyard and you are going to comply with the state and erect the fence to hide said ??? item from view. If they deny then, they have violated a state statute.
