A small number of owners are exploring requesting an easement from the HOA to build a dock that would only be used by a portion of the HOA members. Those members would pay for the dock and upkeep, but the board is wondering if this is even possible to grant an easement, and what liabilities this creates for the HOA. Going to our lawyer is the next step, but if anyone can share any knowledge or experience on this it would be appreciated.

Hi,

I think what you’re requesting is possible. I have personally not experienced it but I don’t see why it wouldn’t be possible. I’d go ahead and check with your lawyer. This isn’t something that just anyone can tackle.
