Can We Elect New Members if the HOA Is Stagnant

    I’ve just moved into a new HOA, and I’ve realized that all of the board members’ terms have expired. No one seems to be taking action on anything, and it feels like the place is stagnating. Can we just elect new members, or does something else need to happen?

    That’s a tough situation. I believe that the HOA should hold elections even if the board members’ terms have expired. Check your governing documents—there might be a provision for filling vacant positions or holding elections in such a case.

    If the HOA is inactive and unresponsive, I’d say that it’s time to get new members in place. If the current board isn’t making any moves, I think you can petition for a new election. You may want to contact a lawyer to confirm the process, though.

    I went through something similar in my old community. What worked was rallying a few neighbors to demand a meeting. If enough people show interest, you may be able to push for a vote or even appoint temporary members until elections are held.

    In our HOA, we had a similar issue, and eventually, the remaining board members just kept electing themselves. Make sure to check the bylaws for a specific process for re-electing a new board. If nothing’s happening, start gathering support from other homeowners to get things moving.
