Are HOA Inspections Allowed in Backyards?

    Our HOA recently started doing inspections of backyards, claiming they’re checking for compliance with landscaping rules. I feel like this is an invasion of privacy. Can they do this?

    It depends on your governing documents. Most HOAs have the right to inspect common areas, but private backyards? That’s unusual unless they have a specific reason.

    We had this issue! Our board clarified that they only inspect visible parts of backyards from common areas. Ask for their policy.

    They say the inspections are allowed under the covenants, but it’s still unsettling. Can I refuse them access?

    Check your state laws. In some places, HOAs can’t access private property without notice or an owner’s consent unless it’s an emergency.

    If it’s about landscaping, maybe you can send photos instead of letting them in. Offer an alternative to avoid conflict.
