Voting Rights of Spouses on HOA Board in Maryland

Question:

Can a husband and wife serve on the same board at the same time in Maryland? If so, how many votes do they get when the Declaration has one vote per household.

– Dottie

Answer:

Hi Dottie,

Maryland law currently does not address spouses on an HOA board. However, it is best to check your HOA’s bylaws to see if it is permitted in your association. Generally, the one vote per household rule applies to votes open to the membership. For board matters, spouses each get a vote. That said, you should still read through your bylaws to understand your specific guidelines, requirements, and procedures.
