Vote to Approve Assessments in North Carolina HOA

Question:

Does an HOA normally hold a vote to determine whether an assessment will pass, or can they just issue the assessment?

– Laura

Answer:

Hi Laura,

The HOA board generally holds the authority to set assessments as it sees fit to meet the requirements of the budget. That said, HOAs in North Carolina must hold member meetings for the consideration of budgets proposed by the board. The board must provide members with a summary of the budget within 30 days of adopting a proposed budget. The board must also provide notice of the membership meeting where the vote on budget ratification will be held.
