Hi Paul,
Both the Common Interest Community Association Act and the Condominium Property Act prohibit members from the same unit to serve on the board simultaneously.
765 ILCS 160/1-35(b) states: “If there are multiple owners of a single unit, only one of the multiple owners shall be eligible to serve as a member of the board at any one time, unless the unit owner owns another unit independently.”
765 ILCS 605/18(a) states: “if there are multiple owners of a single unit, only one of the multiple owners shall be eligible to serve as a member of the board at any one time.”
