Solar Energy Devices in Arizona HOA

I currently reside Desert View subdivision. I am interested in getting solar panels for my home. My understanding is that hat I need the HOA approval to receive the Solar panels needed for my home. Do I have requested approval?

Hi Michelle,

Section 33-1816 of the Arizona Statutes does not allow HOAs to prohibit the installation or use of solar energy devices. However, it does permit HOAs to adopt reasonable rules regarding the placement of the device, so long as these rules don’t prevent the installation, hinder the functionality of the device, restrict its use, or affect the cost or efficiency of the device in a negative way.

Your HOA may also ask you to go through an approval process. Check your governing documents for the exact requirements and procedures for this approval process.
