Question:
All my potential buyers are being denied a mortgage by their lender because my association is in litigation with their insurance company regarding damages they claim is from hurricane Irma in 2017.
The banks/lenders need an attorney statement of opinion regarding the liability of homeowners.
They have not been able to get this document.
Right now I’m in limbo unable to sell my property.
Do I have any recourse?

Answer:
Hi Marcia,
Unfortunately, you might need to wait out the litigation before you can sell the home. Most banks and lenders won’t agree to finance a home when they know the HOA is in the middle of litigation.
