My HOA has approved fence spec’s outside of the approved spec’s we must comply with. When we applied for the same exact fence we were denied, citing the bi-law. We live next door to all of the houses that were granted exemptions.

It sounds like you are describing a case of selective enforcement. Approach your HOA board with documented evidence of your argument. Let them know that selective enforcement can render rules invalid, void, and unenforceable.
