Question:
I own a townhouse in SC. Over 1 year ago I had several leaks in my roof. The roof was repaired, but the shingles uses are a completely different color. Resulting in the value of my home being decreased.
What re my legal rights and how can I take action to have this situation rectified?
Thanks!

Answer:
Hi Jennifer,
In South Carolina, if your townhouse is part of a homeowners association or a condo regime, your rights may depend heavily on whether the roof is classified as a common element or part of your individual unit’s responsibility under the governing documents.
If your HOA was responsible for repairing the roof, you have some options. First, review your CC&Rs and architectural guidelines to determine whether roof materials must match in color and style. If those documents mandate uniformity or provide for owner approval on exterior modifications, you have stronger standing to challenge the repair. Next, submit a formal written complaint to your HOA requesting corrective action, such as replacing the mismatched shingles.
