Question:
At a recent HOA meeting and vote for board members, a number of unit owners gave proxies to other parties to vote for them. Are owners entitled to know what owner voted by proxy and who they gave their proxy to? I am not asking who the person holding the proxy actually voted for, only who gave a proxy and who received the proxy.

Answer:
Hi Roberto,
In Pennsylvania, HOA members generally have the right to review certain association records, including election-related documents. While state laws require associations to maintain records of votes, proxies, and ballots, they do not explicitly state that members have an automatic right to know who gave a proxy and to whom. However, if your HOA’s governing documents, such as bylaws or election rules, specify transparency in voting procedures, then members may be entitled to that information.
Additionally, Pennsylvania law allows unit owners to inspect association records related to elections, which could include proxy designations unless explicitly protected as confidential. If the HOA denies access to this information, a formal request citing applicable state laws and governing documents may help clarify whether the records should be disclosed.
