Question:
Hello. Is it legal for HOA to require that all credit checks go through them for prospective tenants of OWNERs? HOA and or its Board members also own rentals and I have always believed this was a grave violation. Personally, I am an owner and have my own property management and I dont understand why its a requirement nor how it can be legal. Thank you for the info.

Answer:
Hi Noni,
It is common practice for homeowners associations to regulate rentals in the community. This can include approving or denying tenants as well as asking for their information (including credit checks). Make sure your HOA has the authority to do this by checking your association’s governing documents.
