Can an existing Board member or any resident of the community run for re-election/election if they have existing violations and/or been sent to collections for nonpayment of HOA account?

Hi Deborah,
Maryland law currently does not address this. However, your HOA’s governing documents may. Check your CC&Rs and bylaws to see what qualifications homeowners must have to be able to run for positions on your HOA board, and whether or not those with current violations or unpaid dues can become candidates.
