Question:
Covenant 7.12 PARKING states the following: There shall be no resident on-street parking within this subdivision.
Between my wife, my teenage son and myself, working, school activities all at different times my son parks in front of my house. If we have to park in the drive way we are constantly having to do the car shuffle. Can the CC&R stop us?

Answer:
Hi Mark,
The HOA generally can’t restrict parking on public streets (streets that don’t belong to the HOA). However, an HOA is able to restrict parking on private streets. That said, there may be local laws or ordinances at play here, too, so it is best to check if local laws limit your ability to park on the street. Additionally, if local laws allow the HOA to impose such a restriction, then you must follow it.
