Question:
Hi, we have neighbors right behind us that moved in about a year ago and they cleared all the brush no fence put up and they’re riding motorcycles and three wheelers over there 17 feet behind. Our house is in our HOA. It’s not allowed the president will not do anything about it. We do have an attorney, but it’s just becoming too expensive.

Answer:
Hi Catherine,
Kindly review the governing documents to verify whether their actions were against the community’s rules. It may also help to talk directly to the neighbor to come to an agreement. If that is not possible and the neighbor is breaking the rules, you may speak with the other board members to address the issue. Please exhaust all forms of communication with the board to report the violation such as text, call, mail, and email.
If the board is unresponsive or will not enforce the rules, you may remove the problem board member(s). The Oregon Planned Community Act Section 94.640(6)(a) states that unless otherwise stated in the governing documents, the community may remove board members with or without cause by a majority vote at a meeting with a quorum (other than those appointed by the declarant or ex officio board members). For further guidance, kindly consult a lawyer.
