I have a dripping toilet in my condo from the unit above me. This is an ongoing problem since
Mid-December. Initially the HOA handyman diagnosed the wrong unit and has stood by that determination. HOA has dropped the ball. The HOA is changing 5-1-25. I had my condo fixed after the first sign, then a stream started two weeks after I had my place repaired. I had a lawyer send demand letter to hoa, this is when hoa dropped the ball. Can you help?

Under the Illinois Condominium Property Act, your HOA is responsible for maintaining and repairing common elements, which may include plumbing lines behind walls or ceilings. If the water intrusion is caused by a defect or leak in the common elements or the failure of the HOA to address it, then the HOA may be liable for both the source repair and damage to your unit.
With a new HOA board coming on May 1, 2025, prepare a full written timeline with supporting documentation including all communication with the HOA, repair receipts and photographs, a copy of the demand letter from your attorney, and any expert or plumber reports showing the source of the leak.
Present this to the new board immediately after their transition. If the current board continues to ignore the issue, your next step may involve legal action.
