Question:
We have lived in our home for 7 years and have never paid a HOA fee for anything. Our streets are maintained by the city. We take care of our own property and snow removal. The developer has decided to expand this subdivision (which is classified as Condominium sites, which he described as doing to have an easier time getting plan approvals, etc through the city bureaucracy), and has now sent all current homeowners a bill for Michigan taxes, CPA Group, and Eden Lawn Care that we don’t understand what lawn they’re doing except around his advertising sign. My question is since we never agreed to an HOA can he just send bills. He did have people who bought homes from him in phase 2 pay a one time $200 fee to join. Phase 1 and most of phase 2 have never paid a fee, even a one time fee. What should we do now. Being a senior living on fixed income I’m leary that he’ll keep increasing fee.

If your home or condo is part of an association, you should be able to see that in the contract or real estate title. If no such clause exists and you never signed an agreement to join the association, then the home or unit does not belong in an HOA and you shouldn’t be mandated to pay the fee.
