Owners’ Right to a Disciplinary Hearing in Alabama

Question:

How difficult is selective enforcement of bylaws to prove?
Does the law which provides owners a right to a hearing when a punitive case is being made apply in every state ?

Answer:

Hi,

An HOA must give homeowners an opportunity to be heard for any violations (Section 35-20-11 of the ALABAMA HOMEOWNERS ASSOCIATION ACT and Section 35-8A-302 of the ALABAMA UNIFORM CONDOMINIUM ACT OF 1991).
