Question:
As a homeowner, the HOA is in litigation for years with a couple owners and the cost has been mounting through lawyers’ fees, HOA fees and special assessments sometimes twice yearly.
There is no end in sight for any resolution with the litigations.
When can an HOA call an end to these litigations as there is no end in sight and possibly write this off as bad debt?
Thanks
– Kirby
Answer:
Hi Kirby,
Your HOA board should examine the circumstances surrounding the association and its finances. The board, along with advice from the HOA’s lawyer and management team, should make this decision. Homeowners can reach out to the HOA board and express their concerns at a board meeting or by contacting the board members directly.
