Question:
What can be done when you are not receiving communication from both the property manager and HOA? We reported that water was coming into our unit 10/2021 send all the documentation that supports that our walkway and rain diverters need to be redone. The property manager did not address and then it changed companies April 2022. We were told that this would be taken care of with high priority.
We were told that the roof warranty company needed to move the rain diverters first so that it would not affect warranty. However, I just spoke with the warranty company and they advised that they just take care of the shingles and the certified installer would need to move them and that would not impact the warranty. I emailed the property manager the information and requested for the 4th time to have the Condo president contact us but we have not heard from anyone.
We have mold in our basement because of this issue and we had already spent money to clean it up last year, but since it has been over a year we now have mold again. We can not keep spending money due to the negligence of the HOA and property manager. What is our best next steps? We know that we are not the only ones that are having issues getting their property issues address, many people are frustrated.

Make sure to exhaust all communication methods to reach out to your HOA board and management company. You may also raise this issue at the next open board meeting. If you are dissatisfied with the way your management company is handling the matter, you might consider switching companies or removing board members. The New Hampshire Condominium Act provides guidance on how you can remove directors and officers. If you are not a condominium, your bylaws can help you with this process. Beyond that, you may need to consult a lawyer for further advice.
