Large Special Assessment After Raising Fees

Question:

Can a H O A suddenly demand $5000 by the end of the month or say the will send fines and put a lien on a house? The board already raised the HOA fee this year by 400 a quarter. The community well for irrigation broke.

According to the state’s Homeowner’s Association Act Section 55-3207(1), the HOA may levy assessments for reasonable costs incurred in common area maintenance. The new assessment may have been levied to fix the broken well. They may also file a lien for unpaid assessments. However, it’s best to review the governing documents to verify whether there are limits to how much the HOA can raise fees and how much special assessments can be.
