Is the HOA Responsible for Homeowners Insurance in Florida?

Question:

Since the HOA pays the homeowners’ insurance premiums, would they not be responsible to maintain the structure? Therefore, would termite treatment not be an HOA responsibility? If not, how would a row of eight connecting townhomes/condos agree on the treatment and large cost of tenting the building? If we have ONE homeowner not participate, tenting would not take place. Isn’t the HOA responsible if the termites continue to do structural damage?

Hi Lynne,

The HOA usually only pays for insurance covering the HOA’s property. This includes common areas and amenities such as elevators, pools, etc. Homeowners are generally responsible for their individual homeowners insurance unless otherwise specified. In a condo community, the HOA is responsible for specific components of the building. Unit owners are still responsible for the interior of their units. Check your governing documents to better understand your HOA’s insurance requirements and policies.
