Inspecting Records Including Employee Compensation in California

Question:

According to the Davis-Sterling Act members are allowed the following fall under association records and enhanced association records that members can inspect a majority of financial statements, reports, and records. Does this include the salary/wages of employees of the Association? As long as there are no personnel records such as disciplinary actions, medical info, etc., I don’t see why salary/wages should be privileged.

Hi Agustin,

According to the Davis-Stirling Common Interest Development Act Section 5215(b), unless provided by attorney-client privilege, associations cannot withhold or redact information concerning employee, vendor, or contractor compensation, as stated below:

“(b) Except as provided by the attorney-client privilege, the association may not withhold or redact information concerning the compensation paid to employees, vendors, or contractors. Compensation information for individual employees shall be set forth by job classification or title, not by the employee’s name, social security number, or other personal information.”
