Answer:
It depends on the HOA’s governing documents. The CC&Rs and bylaws should tell you whether or not homeowners have a right to inspect the contract of the HOA with the property manager. In Idaho, Section 30-30-1102 of the Nonprofit Corporation Act specifies that a member may inspect and copy any of the corporation’s records described in Section 30-30-1101 at a reasonable time and location. However, the Section does not include contracts, and there are some documents that may be withheld from inspection, such as personnel and employment records.
