Inspecting Member Contact Information for Elections

Does an HOA candidate have a right to access from the board the voters contact information in order to ask for votes?

Answer:

Hi Edward,

If the HOA is a non-condominium common interest community organized as a non-profit with ten (10) units or less or an annual budget of $100,000 or less, it may be subject to the General Not For Profit Corporation Act of 1986.

According to Section 107.75(a), a corporation shall keep at its registered office or principal office a record giving the names and addresses of its members entitled to vote. Any voting member shall have the right to examine, in person or by agent, at any reasonable time or times, the corporation’s books and records of account and minutes, and to make extracts therefrom, but only for a proper purpose.

However, whether or not asking for votes is a “proper purpose” may depend. For further guidance, kindly consult a lawyer.
