Indiana HOA Board Raises Dock Rental Fee

Question:

We have association docks some are lifetime (99 year leases)
Others are rentals. Can the board raise the rates of the rentals spots with out consent of the entire association or may the board solely make that decision

Hi Chamberlea,

Generally, the HOA board can raise the fees without obtaining approval from the membership. The board must make decisions that are within the best interest of the association as part of its fiduciary duties. If the board feels that raising the fees would be in the best interest of the HOA, then it can do so. That said, you should also check your governing documents to see if they impose a limit on rental fees.
