Question:
Is it mandatory for a property (private, individual houses) located within what is supposed to be an hoa to have the existence of the hoa listed on the deed?
– Gary
Answer:
Hi Gary,
There is currently no law in New York that requires the existence of the HOA to be included in the property deed or title. That being said, sellers are encouraged to disclose the existence of the HOA by supplying the buyer with a copy of the HOA documents (bylaws, CC&Rs, financial statements, etc.).
