Question:
Hi – I am the principal trustee for my HOA. I am in a building of three units. The occupant of Unit 2 is a fellow owner. The occupants of Unit 1 rent, and the owner of Unit 1 is only reachable through a third party building management company. I need to increase the monthly condo fees and am not receiving a reply from anyone. Where can I turn to get the other two owners to comply with my increase? Thank you.
– Melissa
Answer:
Hi Melissa,
Kindly review the governing documents to see whether there are provisions regarding fee increases. They may indicate whether or not the HOA needs approval from the members to increase the fees.
Normally, the board does not need a vote. They simply present a new budget at the annual meeting with the proposed fee increase and approve the budget during the meeting. They may need to send a notice of the increase to the members depending on the requirements of the governing documents. Afterward, the HOA can simply charge the increased fees and the homeowners must comply.
However, if you need a membership vote, it might be best to exhaust all forms of communication with the other members. Send them notice or contact them via text, mail, email, or call. You may also visit them in person if necessary. For further guidance, kindly consult a lawyer.
