To terminate an HOA in Pennsylvania, the association must secure the agreement of unit owners of units to which at least 80% of the votes in the association are allocated, or any larger percentage the declaration specifies. You will need to execute a termination agreement or ratifications thereof. This agreement should specify the date it was first executed or ratified by a unit owner. It must then be recorded on or before the date specified in the agreement or within one year from the date it was first executed or ratified by a unit owner.
Title 68 Section 3220 of the Pennsylvania Consolidated Statutes provides more information for condominiums while Title 68 Section 5220 provides information for planned communities.
