Hi Michele,

Changing a condo association’s bylaws usually does not require the approval of members but rather only the approval of the board. The method for amending the bylaws can usually be found within the bylaws themselves. On the other hand, amending a condo association’s declaration or CC&Rs does need approval. Section 47C-2-117 of the North Carolina Condominium Act lays down the requirements and procedures for the amendment of a declaration. It is worth noting that rental restrictions are usually contained in the declaration or CC&Rs — not the bylaws.
