How Many Board Members Must an HOA in North Carolina Have?

Question:

We have over 50 home s here but just 2-member on the board. No one wanted to run or deal with all the headaches. So, my question can we have just 2 members or do we need to dissolve the HOA?

Answer:

Hi Miguel,

According to North Carolina law (Section 47F-3-103), the board should have at least three (3) members, most of whom must be lot owners. In the event of a vacancy, existing board members can appoint a replacement board member to complete the rest of the unexpired term of the vacancy. To terminate an HOA, the North Carolina Planned Community Act requires 80% of lot owners to agree to the termination (or a larger percentage according to the association’s declaration).
