HOA Won’t Clean Owner’s Yard in CT

Question:

My HOA will not clean up my backyard. It is full of dead trees and overgrowth. What do I do next?

– Misty

Answer:

Hi Misty,

First of all, it is important to determine who is responsible for maintaining your backyard. Your HOA’s governing documents, specifically the community plat and CC&Rs, should be able to tell you whether the backyard is your responsibility as a homeowner or the HOA’s responsibility. Generally, backyards fall under the responsibility of the owner (you), but you should still check your governing documents.

If you determine that the backyard is the HOA’s responsibility, though, it is best to reach out to the HOA board or manager. Let them know that they have neglected to maintain your backyard as per the governing documents. Make sure to exhaust all communication channels, including attending a board meeting.
