Question:
Martin County Fl. was impacted by several Tornados spurred by Hurricane Milton. I live in Stuart Florida. we have an HOA. The HOA has not been ( somewhat) compassionate about all the damage suffered by residents here. roof, homes ( some ) semi destroyed , common areas tree damages . Ins. companies are not paying us quickly leaving to some having to use their own funds to repair/replace . The HOA is saying we have to complete repairs/roof replacement to where it was before the tornado hit us in October 2024, there is no leeway as they are quoting the By-laws as the properties must be maintained in proper standing. ( that we agreed to those terms when we purchased here ) No one is a millionaire here. There has to be some relief to this type of thinking . Is there an agency to contact so they do not bully us. we are all waiting to vendors to fix things here, garages , screening , patios . a lot of older people reside here as well who do not have excess funds to comply with everything at once.

Answer:
Hi Ana,
Dealing with the aftermath of tornado damage can be incredibly challenging, especially when your HOA is enforcing strict rules despite the financial and logistical difficulties faced by residents. While the HOA is likely referencing its bylaws requiring properties to be maintained to community standards, it is important to emphasize that these are extraordinary circumstances that warrant flexibility. You and your neighbors can unite to approach the HOA as a group, advocating for temporary relief measures such as extended repair deadlines or allowances for phased restoration work. Talk to your HOA board.
Further, consider reaching out to local or state resources for disaster recovery assistance, such as Martin County’s housing offices or federal programs like FEMA’s Individual Assistance Program, which may provide financial aid for uninsured damages. If delays in insurance payouts are creating significant barriers, the Florida Department of Financial Services’ Division of Consumer Services can help escalate claims.
