HOA Neglecting Lawn Maintenance in California

Question:

Hello,

My HOA just turned off all the sprinklers in my 147 unit condo complex and the lawns have turned brown.

The homeowners pay for this watering service with monthly HOA dues along with landscaping services and security. Both have disappeared and yet homeowners are being asked to pay more for HOA.

The grounds look barren. The HOA has not spent any money on native trees, shrubs, succulents or flowers of any kind.

What are my rights as an HOA homeowner?

Thank you,

– Julie

Answer:

Hi Julie,

According to the Davis-Stirling Common Interest Development Act Section 4775(a)(1), the association is responsible for maintaining common areas unless otherwise specified in the governing documents. Kindly refer to the governing documents to see whether there are provisions that exempt the HOA from maintaining the lawn. If there are no exemptions, you may raise this concern with the HOA board.
