HOA Bookkeeper Failing to Fulfill Duties

Question:

Our bookkeeper is not doing the books and is refusing to turn them over can he be changed? What do we do?

Answer:

Hi Rebecca,

If your bookkeeper is an HOA officer, you may remove the person in question. According to the Louisiana Business Corporation Act Section 1-843(B), you may remove the officer with or without cause, as stated below:

“B.  An officer may be removed at any time with or without cause by any of the following:
(1)  The board of directors.
(2)  The appointing officer, unless the bylaws or the board of directors provide otherwise.
(3)  Any other officer if authorized by the bylaws or the board of directors.”

If your bookkeeper is from an HOA management company, you may raise your concern with the HOA manager or management company.
