What are the Kansas laws regarding HOA Board Elections?
-Do the notices need to be sent certified mail?
-Does there have to be a Quorum in attendance?

You will find election and voting procedures under Section 58-4614 of the Kansas Uniform Common Interest Owners’ Bill of Rights Act as well as Article 65 of the Kansas Corporations Code, the latter of which applies to HOAs that are organized as corporations. Furthermore, your HOA’s bylaws should reflect your election rules and procedures. If your bylaws are silent on this, it is imperative to amend your bylaws to include such provisions and set a standard for future elections.
