If this is a matter of withholding rights and privileges by suspending someone’s access to certain common areas due to a violation, the HOA may be able to do so with only eyewitness evidence from members or board members. Nonetheless, it’s best to review the governing documents to see what the requirements are for evidence regarding violations.
