HOA Asking for LLC Articles of Incorporation

Question:

Can an HOA demand that an owner show the HOA their LLC articles of incorporation? It doesn’t seem like it’s any of their business.

Answer:

Hi Elizabeth,

It depends on the situation. If the owner’s LLC Articles of Incorporation are relevant to the HOA’s affairs, then the HOA may be able to ask for a copy of it, depending on the governing documents. For instance, if the HOA allows businesses to be run within the community but has certain requirements that must be met.

That said, the Articles of Incorporation of a company are a matter of public record anyway. As such, the HOA can simply look for the document on the website of the NC Secretary of State.
