HOA Approved Neighbor’s Fence But Not Mine

I live in a HOA where they allow privacy fences. My house backs up to a preserve so I asked if I could do railings on the back part to allow ventilation and not block the view. They said no so I did a full privacy fence,
One month later my next-door neighbor did what I wanted. The owner said the HOA approved it. I submitted my paperwork to change my fence and I was denied again. They said my neighbors was never approved and they are in violation. I do not believe the HOA I believe the neighbors fence was approved. What can I do?

It is possible that your request was inconsistent with the architectural rules of the HOA. It might have not conformed with the design specifications of your association, while your neighbor’s might have. You can ask your HOA board for the exact reason of the denial of your fence.

If possible, ask for written confirmation of your neighbor’s approval status and any meeting minutes or documents related to the review of both your and your neighbor’s applications. Seeing the paperwork might clarify if the HOA initially approved your neighbor’s fence and then reconsidered or if there was another administrative error.

Keep records of all communications with the HOA, including your initial request, their denial, and any responses about your neighbor’s approval status. This documentation could be valuable if you need to escalate the matter.

If you find that there’s been an inconsistency, let your HOA board or community manager know. Consider writing a formal letter or raising the concern at your next board meeting.
